Aljosa and Millie worked on a leasehold purchase for me and were both great at responding to my queries promptly. As a first time buyer, I had many questions and Al was great at being patient and answering them. I felt supported throughout the process.
David Bailey, specialist negligence solicitor, advised that my claim was worth £70k at least, whereby a claim was made against the Defendant of some £150k. As a precaution against costly court fees, in the event the case would end up in court, I had in place legal insurance cover, and had discussed at the outset, and went through the process of getting the solicitors’ approved by my insurance company. David advised to sue the Defendant and requested for me to pay Healys a court fee of some £8k to initiate court action. I was very hesitant about escalating the case to court and advised Healys that my preference was to try to settle the claim without court action and that it should only be a last resort. When again a summary was being made of the claim, I was advised by phone from David’s assistant solicitor that the Defendant had commented that the claim could well be restricted and based on the diminution in value of the lease only amounting to £15k, and not the substantial claim presented to them. I had to constantly ask David to give a figure of what the claim was really worth in writing, even long after incurring hefty costs, when I was told it was now between £40k & £160K. Knowing now that there could be a restriction on the claim, I requested a meeting between the two principle solicitors acting for me, at which they both allayed my fears. David told me at the meeting that the Defendants didn’t know what they were talking about and that my claim remained substantial at £70k minimum. I was told that I should not be concerned at all as it is all part of the process of negotiation. Such comments served to give me comfort. I was asked at this meeting to give a reference of the firm, although thought it odd that I was being asked this before the case had finished, and so I held off the request and didn’t complete the form. The position, after a switch in solicitors, then suddenly changed and I was informed by David that I will need to either accept a low Part 36 offer of around £27k from the Defendant or sue the Defendant at an approximate cost to me of some £170k. Gone was the optimism. I was duly alarmed at the change in optimism by David, for which I then enquired about whether we can have a mediator jointly appointed, in order to circumvent the need to embark on court action. Something that, I believe, should have been as an option put to me by David and not the other way around. At the mediator’s hearing that followed, my solicitor told me during the lunch interval that the Defendants were numpties and that they didn’t have any idea about what they are doing. Upon resumption of the hearing in the afternoon, David told the mediator that my claim was really worth at least £200k, to which the mediator responded and said that it could well be the case that if the case went to court I may only be entitled to a low diminution in lease value of some £15k plus a percentage of legal costs. I was very surprised to hear that my solicitor agreed with the mediators premise on this point, for which he then went quiet, and so indicated to me that my case was, in fact, much weaker than he had let onto me in respect of costs since the Defendant had already accepted their responsibility of fault at the early stage of the claim. At the end of the hearing a low settlement figure was agreed which needed my acceptance within a few weeks, following which my solicitor advised of my options, being to either accept the tabled offer or to still sue the Defendant. David then disturbingly advised me that he was unwilling to work with my insurers on the claim, though he then went on to immediately proffer his services to continue the case privately, whereby I wouldn’t then have insurance cover. I felt let down by David by telling me this at the last moment, and when there would be no time to appoint another firm of solicitors to take over the case. Given that David had readily accepted at the hearing the mediator’s premise that my claim could be viewed by a judge as being mostly restricted, implied that it would have been a huge risk and foolish to have embarked upon a court case, particularly without insurance cover. After this hearing and having considered what had transpired throughout the process, felt that I had been misled and duped by David, whereby I received around £10k net, whereas Healys fees were substantially more. I therefore raised a complaint to the Chairman of Healys, who took seven months to respond, even after having chased it up several times. Being disappointed with the complaint procedure and outcome, I then took the case up with the legal ombudsman, although they advised me that they do not look at negligence nor dishonesty of a solicitor, as that is something the complainant would have to undertake with legal redress themselves with another firm of solicitors.
I am so incredibly disappointed by the consistent lack of communication and effort from the entire Healys team. They were recommended and highly rated but the level of service we’ve received has been very poor. 9 months after we first engaged with them and 5 months after we asked them to work at pace we find ourself with a flat purchase at risk because our sellers are tired of waiting with no communication from Healys. As an example, our assigned solicitor responds to 1 in 4 emails from the seller’s agent. I was at my wits end in July and two months later I cannot even describe the state I am in. I wish I changed to another solicitor in July.
Al and Millie worked on a leasehold purchase for us and were extremely diligent and responsive. Given it was our 1st leasehold property purchase we had many questions and they always made time for us. This is the 2nd time we have used Healys and have been very happy with their work.
